Why set up a compliance program?

Compliance programs do not only concern large companies but all companies exposed to corruption risks, depending on their activities.

Indeed, putting in place compliance measures adapted to the company's risk profile provides reasonable assurance that the company has protected itself against the main risks related to its activity.

These risks can have legal (particularly criminal), financial (sanctions) or reputational impacts.

The pillars of a compliance program are based in particular on a risk map that makes it possible to:

  • Assess and prioritize corruption risks
  • Define risk management measures adapted to the governance and organization of the company.


Risk mapping, the cornerstone of the programme

To carry out a risk map, companies, regardless of their size, can rely on the recommendations of the French Anti-Corruption Agency (AFA), first of all to identify, analyse and prioritise the risks of corruption and more generally of fraud and embezzlement.

This mapping can also make it possible to identify and assess the risks of non-compliance with competition rules, social and environmental commitments, or international trade rules or anti-money laundering rules.

Depending on the risks selected, the company may define action plans aimed at reducing the impact or frequency of risks through targeted risk control mechanisms, such as:

  • the establishment of an internal whistleblowing system,
  • a policy for managing gifts and hospitality,
  • a conflict of interest management policy
  • strengthening the control of purchase or sale policies,
  • the definition of anti-corruption accounting controls.

A risk map is an effective tool for managing your company's risks, likely to reduce the consequences of a possible non-compliance with the laws and regulations that are imposed on it, and to limit the liability of the company and its managers.
